1. General Information and Medical Disclaimer

The information provided on this Website is for general informational and educational purposes only.

Website content is not intended to constitute medical advice, diagnosis, treatment advice, or a substitute for consultation with a qualified healthcare professional who can assess your individual circumstances.

Use of this Website, including submitting an inquiry or consultation request, does not by itself establish a healthcare provider-patient relationship with DMA or any healthcare professional associated with DMA.

Treatment suitability, expected outcomes, risks, benefits, contraindications, recovery and other clinical considerations vary from person to person and should be discussed directly with an appropriately qualified healthcare professional.

The Website should not be used for medical emergencies or other situations requiring immediate medical attention.

2. Treatment Information and Results

DMA makes reasonable efforts to provide accurate and current information regarding the treatments, technologies, products and services described on the Website. However, medical and aesthetic information evolves, treatment protocols may change, and services or products may be modified or discontinued.

Descriptions of treatments, expected benefits, recovery periods, treatment frequency and potential outcomes are general in nature and are not guarantees of individual results.

Before-and-after photographs, testimonials, reviews and other examples appearing on the Website illustrate individual experiences only. Results vary between individuals, and similar results cannot be guaranteed.

Final treatment recommendations are made following an appropriate consultation and assessment.

3. Website Content and Availability

The Website and its content are provided on an “as is” and “as available” basis.

Although DMA takes reasonable steps to maintain accurate and useful information, we do not warrant or guarantee that:

* the Website will always be available or operate without interruption;
* defects or errors will always be corrected;
* the Website or the servers used to provide it will be free from viruses, malicious code or other harmful components; or
* any particular product, treatment, service, appointment time or promotion displayed on the Website will remain available.

DMA may modify, remove, discontinue or update Website content, products, services or features at any time.

4. Permitted Use of the Website

You may access and use the Website for lawful, personal and non-commercial purposes.

You agree not to:

* use the Website in violation of any applicable law or regulation;

* use the Website to transmit malicious software, spam or unlawful material;
* copy or commercially exploit Website content except as expressly permitted by DMA; or
* use DMA’s name, trademarks, branding or content in a manner that falsely suggests endorsement, sponsorship or affiliation.

DMA may restrict or terminate access to the Website where we reasonably believe these Terms of Use have been violated.

5. Intellectual Property

Unless otherwise indicated, the Website and the original content created for DMA, including its text, graphics, photographs, videos, design elements, logos, branding and other materials, are owned by or licensed to Distinct Medical Aesthetics and are protected by applicable copyright, trademark and other intellectual property laws.

Third-party trademarks, trade names, product names, photographs, graphics and other materials remain the property of their respective owners. They are used under licence, with permission or as otherwise permitted by law.

No ownership rights are transferred to you by your use of this Website.

You may view, download or print reasonable portions of the Website for your personal and non-commercial use, provided that you do not modify the material or remove copyright, trademark or other proprietary notices.

* does not falsely imply that DMA endorses, sponsors or is affiliated with another person, business, organization, product or service; and
* does not display the Website within a frame or otherwise misleadingly present DMA content.

DMA reserves the right to request removal of a link where we believe the link is misleading, unlawful, damaging to DMA’s reputation or otherwise inappropriate.

7. Third-Party Websites and Services

The Website may contain links to websites, platforms, manufacturers, payment providers, booking systems, social media services or other resources operated by third parties.

These links are provided for convenience and informational purposes.

DMA does not control third-party websites and is not responsible for their content, availability, privacy practices, security, accuracy or terms of use. The inclusion of a third-party link does not necessarily constitute an endorsement or recommendation by DMA.

Your use of third-party websites and services is subject to the terms and policies of those third parties.

8. Online Purchases, Promotions and Other Policies

Certain portions of the Website may allow you to purchase products, request appointments, participate in promotions or use other services.

To the extent permitted by applicable law, you agree to indemnify and hold harmless DMA and its directors, officers, employees, contractors and representatives from claims, liabilities, damages, losses or expenses arising from your unlawful use of the Website, your violation of these Terms of Use, or your infringement of the rights of another person.

12. Governing Law

These Terms of Use and your use of the Website are governed by and interpreted in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.

Subject to any rights or remedies available to you under applicable law, disputes arising from or relating to the Website or these Terms of Use will be subject to the jurisdiction of the courts of Ontario.

13. Severability

If any provision of these Terms of Use is found to be invalid, unlawful or unenforceable, that provision will be severed or limited to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

14. No Waiver
